CNOOC, Nexen reapply for U.S. deal approval

CALGARY, Alberta (Reuters) - China's state-owned CNOOC Ltd and its Canadian takeover target Nexen Inc have withdrawn and resubmitted an application for U.S. approval of their $15.1 billion deal, as Canada gets close to its decision on whether to approve the transaction.

The energy companies said on Tuesday that discussions with the Committee on Foreign Investment in the United States (CFIUS) were still in progress, "with a view to completing the CFIUS review process as expeditiously as possible."

In a brief statement, they did not provide a reason for, or the timing of, the unexpected move. It was not immediately clear whether the announcement meant the process had hit a snag or signaled a delay in closing the deal, which has become a topic of heated debate in Canada.

A spokesman from Nexen was not immediately available for comment. A CNOOC official in the United States declined comment.

The companies filed for approval by CFIUS, an eight-member panel chaired by Treasury Secretary Timothy Geithner, because Nexen has extensive operations in the U.S. Gulf of Mexico.

The review takes 75 days and appeared to be close to conclusion. By law, CFIUS and the Treasury Department cannot comment on reviews, and leaks about their deliberations are rare.

A source familiar with the proposed transaction described the refilling as "routine" and pointed out that other transactions have gone through a similar process.

The panel has the power to negotiate or impose conditions, including divestitures and security-control agreements to mitigate any national security threats. In rare cases, a final decision on whether to allow a deal goes to the president.

North of the border, Canada's Conservative government has set a deadline of December 10 for deciding if CNOOC's takeover of Nexen would bring a net benefit to the country. By law, it must decide whether to approve the deal on that basis, though the term "net benefit" remains imprecise.

Ottawa is trying to balance the need for foreign investment to develop resources such as the Alberta oil sands with concern that China and other countries could snap up a big chunk of the energy sector and that state-owned companies might not play by free-market rules.

The United States has proved skeptical in past years about Chinese investments. CFIUS recently rejected a bid to build wind farms in Oregon by Ralls Corp, owned by two executives of China's Sany Group, and has blocked multiple deals by Huawei Technologies Co, a Chinese telecom equipment manufacturer.

Derek Scissors, research fellow at the Heritage Foundation in Washington, said the resubmission may not be a major stumbling block for the transaction.

"It typically occurs when there's a declaration by the applicant that runs afoul of a CFIUS regulation but can be reformulated. The reformulations usually are procedural, not material."

(AP) ? Americans clicked away on their computers and smartphones for deals on Cyber Monday, which is expected to be the biggest online shopping day in history.

Shoppers are expected to spend $1.5 billion on Cyber Monday, up 20 percent from last year, according to research firm comScore. That would not only make it the biggest online shopping day of the year, but the biggest since comScore started tracking shoppers' online buying habits in 2001.

Online shopping was up 26.6 percent on Cyber Monday compared with the same time period a year ago, according to figures released Monday evening by IBM Benchmark, which tracks online sales. Sales from mobile devices, which include tablets, rose 10.2 percent. The group does not track dollar amount sales.

The strong start to Cyber Monday, a term coined in 2005 by a shopping trade group that noticed people were doing a lot of shopping on their work computers on the Monday following Thanksgiving, comes after overall online sales rose significantly during the four-day holiday shopping weekend that began on Thanksgiving.

"Online's piece of the holiday pie is growing every day, and all the key dates are growing with it," said Forrester Research analyst Sucharita Mulpuru. "The Web is becoming a more significant part of the traditional brick-and-mortar holiday shopping season."

It's the latest sign that Americans are becoming addicted to the convenience of the Web. With the growth in smartphones and tablet computers, shoppers can buy what they want, whenever they want, wherever they want. As a result, retailers have ramped up the deals they're offering on their websites during the holiday shopping season, a time when stores can make up to 40 percent of their annual revenue.

Amazon.com, which started its Cyber Monday deals at 12:01 a.m. Monday, is offering as much as 60 percent off a Panasonic VIERA 55-inch TV that's usually priced higher than $1,000. Sears is offering $430 off a Maytag washer and dryer, each on sale for $399. And Kmart is offering 75 percent off all of its diamond earrings and $60 off a 12-in-1 multigame table on sale for $89.99.

Delisa O'Brien, 24, took advantage of some of the deals on Monday. O'Brien, who said she would rather shop online than deal with the crowds in stores, bought an H-P Notebook for $399 on Hewlett Packard's website for her mother. The company threw in a free Nook e-book reader with her purchase.

"When it comes to Black Friday, I'm a tiny, 5'1" woman and the thought of having to push and shove my way through hoards of people just to get cheap merchandise is kind of a nightmare to me," said O'Brien, a Brooklyn, N.Y. resident. "My mom gets a new laptop, I get an e-reader, and all without spending too much money ... Everybody wins."

Chas Rowland, 34, a pastor in Vicksburg, Miss., agrees. He said that he prefers shopping online on his iPad. On Cyber Monday, he bought clothes at several online retailers, toys at Toys R Us and electronics and phone accessories from Best Buy. He got at least 40 percent off everything and free shipping on some items.

"The best part was that I got to sleep while everyone else was standing in lines all night long on Black Friday," he said.

How well retailers fare on Cyber Monday will offer insight into Americans' evolving shopping habits during the holiday shopping season. With the growth in high speed Internet access and the wide use of smartphones and tablets, people are relying less on their work computers to shop than they did when Shop.org, the digital division of trade group The National Retail Federation, introduced the term "Cyber Monday."

As a result, the period between Thanksgiving and Cyber Monday has become busy for online shopping as well. Indeed, online sales on Thanksgiving Day, traditionally not a popular day for online shopping, rose 32 percent over last year to $633 million, according to comScore. And online sales on Black Friday were up 26 percent from the same day last year, to $1.042 billion. It was the first time online sales on Black Friday surpassed $1 billion.

For the holiday season-to-date, comScore found that $13.7 billion has been spent online, marking a 16 percent increase over last year. The research firm predicts that online sales will surpass 10 percent of total retail spending this holiday season. The National Retail Federation estimates that overall retail sales in November and December will be up 4.1 percent this year to $586.1 billion.

But as other days become popular for online shopping, Cyber Monday may lose some of its cache. To be sure, Cyber Monday hasn't always been the biggest online shopping day. In fact, up until three years ago, that title was historically earned by the last day shoppers could order items with standard shipping rates and get them delivered before Christmas. That day changes every year, but usually falls in late December.

Even though Cyber Monday is expected to be the biggest online shopping day of the year, industry watchers say it could just be a matter of time before other days take that ranking.

"Of all the benchmark spending days, Thanksgiving is growing at the fastest rate, up 128 percent over the last five years," said Andrew Lipsman, a spokesman with comScore.

'Twilight,' Bond, 'Lincoln' lead record weekend

LOS ANGELES (AP) ? Bella Swan, James Bond and Abe Lincoln have combined to lift Hollywood to record Thanksgiving revenue at the box office.

Kristen Stewart's finale as Bella in "The Twilight Saga: Breaking Dawn ? Part 2" was No. 1 again with $64 million during the five-day holiday stretch that began Wednesday, according to studio estimates Sunday.

Daniel Craig's Bond adventure "Skyfall" came in at No. 2 with $51 million, while Daniel Day-Lewis and Steven Spielberg's Civil War saga "Lincoln" finished third with $34.1 million.

According to box-office tracker Hollywood.com, the three films paced Hollywood to an all-time Thanksgiving week best of about $290 million from Wednesday to Sunday.

That tops the previous record of $273 million over Thanksgiving in 2009, when "The Twilight Saga: New Moon" led the weekend.

This Thanksgiving also was a huge 25 percent jump from a year ago, when domestic revenues were a weak $232 million as some big holiday releases fizzled.

With a strong December lineup ahead, Hollywood has resumed its record revenue pace for the year after a brief box-office lull in late summer and early fall.

Domestic revenues for 2012 are at $9.75 billion, putting Hollywood potentially on track for its first $11 billion year, which would beat the 2009 record of $10.6 billion, said Hollywood.com analyst Paul Dergarabedian.

"We're barreling toward a record-breaking box-office year," Dergarabedian said. "It's built on the back of just a lot of really strong movies that have come out over the past few weekends. It bodes very well for the rest of the holidays."

The "Twilight" finale, "Skyfall" and "Lincoln" finished in the same top-three rankings for the second-straight weekend as new releases were unable to dislodge the holdovers.

Released by Lionsgate's Summit Entertainment banner, "Breaking Dawn ? Part 2," pulled in $43.1 million from Friday to Sunday, raising its domestic total to $227 million. The movie added $97.4 million overseas to bring its international total to $350.8 million and its worldwide take to $577.7 million.

Sony's "Skyfall" also topped $200 million domestically, ringing up $36 million for the three-day weekend to put its U.S. total at $221.7 million. With $41.3 million more overseas, "Skyfall" raised its international revenues to $568.4 million and its worldwide sales to $790.1 million.

"Lincoln," a DreamWorks film distributed by Disney, took in $25 million over the weekend to lift its domestic revenue to $62.2 million.

Leading the newcomers was Paramount and DreamWorks Animation's tale "Rise of the Guardians" at No. 4 with $24 million for the weekend and $32.6 million since opening Wednesday.

Based on William Joyce's "Guardians of Childhood" books, "Rise of the Guardians" gathers Santa Claus, the Easter Bunny, the Tooth Fairy and other mythical beings as a team of heroes battling an evil overlord.

Close behind at No. 5 was director Ang Lee's shipwreck saga "Life of Pi" at No. 5 with $22 million over the weekend. The 20th Century Fox release has taken in $30.2 million domestically since its Wednesday debut and added $17.5 million in four Asian markets.

"Life of Pi" was adapted from Yann Martel's best-selling novel about an Indian youth adrift on a lifeboat with a Bengal tiger. Many fans considered the introspective novel impossible to film, but Lee has charmed audiences and critics with an inspiring survival story told through dazzling 3-D images.

The weekend's other new wide release, a remake of the 1980s U.S.-invasion tale "Red Dawn," opened at No. 7 with $14.6 million, raising its total to $22 million since debuting Wednesday.

"Red Dawn" sat on the shelf for three years while studio backer MGM went through bankruptcy, with distributor FilmDistrict eventually picking it up for domestic release. The movie's cast includes Chris Hemsworth ("Thor") and Josh Hutcherson ("The Hunger Games") in a story of young guerrillas battling North Korean invaders.

In limited release, Fox Searchlight's "Hitchcock" opened solidly with about $300,000 in 17 theaters. The movie stars Anthony Hopkins as Alfred Hitchcock in a behind-the-scenes story of the making of "Psycho."

The weekend's overall strength came from a broad range of films that clicked with various audiences, from action and family fare to thoughtful drama.

"This is a marketplace that has something for everyone," said Chris Aronson, head of distribution for 20th Century Fox. "You have something deeper like 'Life of Pi,' yet you have a very successful sequel in 'Twilight' at the same time. Adult bio-drama, if you will, in 'Lincoln,' and you have Bond. That's the secret to a very successful and balanced marketplace."

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

Families of inmates who died at the Orleans Parish jail advocate for ...

They come clutching framed photographs of their loved ones in their best moments: wearing a broad smile at a wedding or posing in full military garb. But the stories they tell don't have happy endings.

Each ends at Orleans Parish Prison. Michael Hitzman and William Goetzee committed suicide, both while they were supposedly under observation by deputies. Cayne Miceli stopped breathing while trying to get out of 5-point restraints, later dying at the hospital. The exact causes of Tracy Barquet Jr.'s death are unknown, but, like Miceli and Goetzee, he died while in the care of the jail's psychiatric unit.

Their family members have unfurled the grim details of these deaths in sit-down meetings with five of the seven New Orleans City Council members and Mayor Mitch Landrieu. All unlikely advocates, several members of the group have become regular attendees at City Council meetings on the jail and its budget.

Their aim is to put a human face on the jail's most troubling statistic: the 38 inmate deaths that have occurred since Hurricane Katrina. But they also are trying to push the city to get on board with a massive overhaul of the jail, a reform that will likely be outlined in a federal consent decree mandating scores of changes in how Orleans Parish Sheriff Marlin Gusman runs his facilities.

"I'll be tormented and tortured every day of my life," said Donna Gauthier, who was engaged to Goetzee before he killed himself in the jail last year. "We thought it was a safe haven. He was getting whatever help he needed."

Sophia Becker, Miceli's sister, said the fact that others lost relatives after her sister's death in January 2009 makes her skeptical about the the prospects of reform under the current leadership. "It is very angering that more families are being affected," she said.

Fixing the mental health care provided by the jail -- which the U.S. Department of Justice has called profoundly inadequate in investigations from 2009 and earlier this year -- is expected to be a key component of a consent decree. In federal court filings, the Justice Department has characterized the settlement as near completion. But negotiations last month hit an impasse over how to pay for the upgrades.

While Gusman has said he supports a decree, he insists one will be possible only if the city puts more money into his operations. Attorneys for the city have scoffed at that contention in court filings, saying there is no evidence that the problems at the jail stem from insufficient funding.

U.S. District Court Judge Lance Africk in October appointed a retired criminal court judge, Terry Alarcon, to try to get the two sides to come to an agreement. The next status hearing is scheduled for Tuesday.

James Hitzman, whose son Michael hanged himself inside a Central Lock-Up cell, noted that the city has found money for a similarly broad consent decree to remake the New Orleans Police Department.

"They should be able to find that money somewhere. If things are not fixed under supervised conditions, things will not change," he said. "It is evident they can't do it on their own."

Civil rights attorney Mary Howell, who represents the four families that have become advocates of reform, said she understands the city's skepticism about simply forking over more money. For years, mayoral administrations and successive sheriffs tangled over how much money is needed to properly run the jail, but never really came up with a satisfactory answer. Now is the time to look to other cities and figure it out, she said.

"I do think it is correct that the city should not be writing a 'blank check,'" Howell said. "What they need to do is insist on transparency and accountability. The situation needs to be audited and monitored."

Each of the four deaths -- which occurred under circumstances that Howell characterized as "questionable" -- highlights significant problems at the jail, she said. Hitzman's wife and children filed a lawsuit against the sheriff's office, which was settled. Lawsuits in the Miceli and Goetzee cases are still pending.

In a statement, Dr. Samuel Gore, the sheriff's medical director, defended the jail's record, saying the jail's mortality rate is below the national average, while the suicide rate is just slightly above the national average and compares favorably to cities like Baltimore, Oklahoma City and Phoenix.

Gore said his staff takes steps to identify medical and psychiatric problems during the booking process, as well as analyzing each inmate death to see what caused it and what shortcomings it points up. He noted that the jail population is a challenging one.

"We encounter individuals daily with untreated or undertreated medical conditions, as well as an increasing number of untreated, undiagnosed or undertreated mental health disorders," Gore said.

But investigators from the Justice Department found that conditions at the jail are unconstitutional. The department detailed problems with how inmates are classified, the levels of violence between inmates and by guards, as well as lack of support for inmates who don't speak English. The agency also repeatedly flagged mental health care as deficient, in particular saying the treatment of suicidal inmates is inhumane.

Miceli's case was highlighted in the first Justice report as an example of how the sheriff staff "fails to protect inmates from harm while in restraints." Miceli was put in five-point restraints - a sort of harness that pins a person down -- after she allegedly attempted suicide in an isolation cell. An asthmatic, Miceli complained about not being able to breathe and eventually tried to get out of her restraints. She collapsed as deputies tried to put her back in them. Miceli had no pulse for about 35 minutes, according to a federal lawsuit, but was revived by CPR. She later died at the LSU hospital when taken off life support.

More recently, an April 2012 report noted that "deficient monitoring" contributed to both Hitzman and Goetzee's deaths. Their suicides were also used as examples of the jail's allegedly inadequate mental health screening.

During his screening, Hitzman admitted to recently swallowing drugs. After acting erratically, he was placed in an isolation cell equipped with a video camera. However, it appears nobody watched the camera's video stream, as no sheriff employee intervened when Hitzman hanged himself with his shirt.

Goetzee, a longtime U.S. Coast Guard employee and commander in the reserves, had been arrested in August 2011 after he tried to grab a gun from a federal security officer outside court. During the struggle, Goetzee said, "I want to kill myself. Give me your gun," to the officer, according to a complaint filed at federal court.

Goetzee had been seeking treatment for his mental troubles, which grew out of work exhaustion and a serious car accident.

Despite this history -- and though he told jail screeners about his suicidal thoughts -- the Justice Department found that Goetzee was initially kept in the general population before being sent to the Interim LSU Public Hospital. After he was returned to OPP, Goetzee was placed on suicide watch.

Goetzee committed suicide while in the jail's suicide tank. He was supposed to be under direct observation, but deputy William Thompson left his post, giving Goetzee time to swallow enough toilet paper to suffocate himself.

Gore pointed to this case as an example of the sheriff's office holding itself accountable, noting that Thompson this year pleaded guilty to criminal charges of malfeasance in office. But Gauthier said the result was unsatisfying, as it appears no supervisors were disciplined for the obvious lapse in protocol.

Most recently, in a federal court filing, the Justice Department noted that Tracy Barquet Jr. died in 2010 days after he was beaten and pepper-sprayed by guards. Barquet's death remains classified as "undetermined" by the Orleans Parish coroner.

Gore noted in his statement that the coroner did not find any "indications of any physical confrontations that would be fatal, nor did the coroner find any signs of suicide" in Barquet's death. According to jail records, a deputy was disciplined for spraying pepper spray at Barquet through the cell bars. While inmates said Barquet was beaten, deputies denied it.

For Tracy Barquet Sr., his 25-year-old son's death continues to raise unresolved questions more than two years later. Barquet acknowledged his son had a drug problem, but said he'd never had a previous history of seizures, one potential cause of death posited by the coroner's office. The events leading up to his son's death - including the alleged beating and pepper-spraying days before it - are troubling, he said.

"I just want some answers," Barquet said. "We did know he was ingesting drugs. He had a problem with that. I thought by him being in there he would be able to detox. That he was safe."

Howell said the deaths point to the need for outside investigations. She has asked Orleans Parish District Attorney Leon Cannizzaro to consider investigating all deaths at the jail. She also noted that Gusman, before he was elected, had pledged to hire an independent monitor, but never followed through.

While the coroner hasn't found evidence of foul play to rule Barquet's death a homicide, an outside probe could determine whether there was negligence or malfeasance on the part of jail staff, she said.

Cannizzaro said he doesn't have the resources to look into deaths at the jail and must rely on the sheriff's office to investigate itself. When a case is brought to the office, whether by Gusman or a victim's advocate like Howell, his staff reviews it, he said.

Gusman has been cooperative when the district attorney asks for files, he noted.

In a statement, Gusman reaffirmed his support for a monitor, saying such a position could "play a productive part of the future of the sheriff's office." The statement did not say why he has never moved to hire one.

The market for Auckland investment properties priced under $2 million is booming, as investors divert money from managed funds into assets they can control directly.

Charles Cooper, the managing director of Colliers Auckland, said the sub-$2m commercial investment market was the company's most active sector and Colliers was selling almost one a day - between 300 and 350 of them a year.

Colliers classified the commercial investment market as any property other than industrial or residential.

As such, it covered a wide range from offices, showrooms and shops to mixed-use properties, and could include anything from bowling alleys to former movie theatres.

He said there had been a lot of talk that the market was being driven mainly by Asian buyers, but that was not correct.

There was a wide range of buyers and they tended to have two main characteristics in common, he said.

Most had what Cooper termed "genuine cash" and so were not borrowing large amounts to make their purchases, and they had lost confidence in other types of investments such as managed funds. They were looking for investments they could control themselves.

There was a mix of first-time buyers and those who were starting to build a small portfolio of properties, he said.

Selling by auction worked particularly well in this market and Colliers was selling 80 to 100 per cent of such properties on the day of the auction.

Cooper believed one of the keys to that success was restricting the number of properties going under the hammer to five or six a day, instead of the mega-auctions some agencies favoured.

That meant the brokers could spend more time during the auction negotiating with vendors and potential buyers to achieve the best price, instead of trying to rush them through.

But in some cases properties are also being sold off-market.

Colliers broker John Davies contacted the owners of the New World supermarket building at Green Bay, which had been owned by the same family for 20 years, on behalf of a private investor looking for such a property. It was sold for $3.3m, providing its new owner with a 5.7 per cent yield.

Although debt was not a big part of the equation for most buyers, the current low mortgage interest rates were helping many raise their sights.

A buyer that might have been looking at paying about $1m for a property when interest rates were higher might look for something closer to $1.25m at the current low rates, Cooper said.

An indicator of the strength of the market was the wide range of properties which were selling.

A property in a great location with a strong tenant on a long-term lease would obviously have buyers lining up and achieve the best price, Cooper said.

But even vacant properties and bare land which could be developed were selling well if they were priced realistically.

Some investors were prepared to pay cash for a vacant property and go without any rental income for six months while they did it up and then looked for new tenants.

Most properties were achieving yields in the 5-8 per cent range.

At least 7 killed in attack on Shi'ite procession in Pakistan

ISLAMABAD (Reuters) - A roadside bomb killed at least seven people near a Shi'ite procession in Pakistan on Saturday, police said, with security forces on high alert over fears of large-scale sectarian attacks on the minority sect across the country.

Pakistan, a nuclear-armed U.S. ally, is suspending phone coverage in many cities this weekend, an important one in the Shi'ite Muslim calendar, after a series of bomb attacks on Shi'ites triggered by mobile phones.

Hardline Sunnis have threatened more attacks as the Shi'ite mourning month of Muharram comes to a climax. More than a dozen people have already been killed this week observing Muharram.

Some Shi'ites have been receiving text message death threats.

Saturday's attack occurred in the city of Dera Ismail Khan in Pakistan's northwest, a stronghold of al-Qaeda-linked Sunni militant groups who regard Shi'ites as non-Muslims and have stepped up sectarian attacks in a bid to destabilize Pakistan.

Four children were among those killed by a 8-10 kg bomb set off by a television remote control device because cellphones were not operational, police said. Khalid Aziz Baloch, a senior medical official, said 30 people were wounded.

The explosion was so powerful that it hurled a young boy onto a rooftop from a street, where a man later carried away half of his body, as a policeman with a bomb detector and residents stood near blood stains.

In neighboring Afghanistan, clashes between Shi'ites and Sunnis on Saturday left two students dead and wounded two more, police said. The fighting took place at Kabul University when Shi'ites were blocked from commemorating Ashura day inside a mosque on the campus.

Mohammad Zahir, head of the criminal investigation department, told Reuters that gunshots were fired close to the university when Hazaras, a predominantly Shi'ite ethnic group, tried to carry out a revenge attack.

Students were seen climbing on to police pickup trucks carrying bags and suitcases. Following the violence, the Higher Education Ministry announced the closure of all universities for 10 days from Sunday.

Intelligence information indicates more attacks have been planned for the coming days in the capital, Islamabad, Karachi and Quetta. Mobile phone service will be suspended for hours in the three cities and dozens of others over the weekend.

For the most part, Shi'ites and Sunnis live in harmony, but extremist groups have increased tensions.

This week's violence against Shi'ites prompted Amnesty International to criticize the Pakistani government.

"Amnesty International has recorded at least 39 attacks on Shi'a Muslims since the start of 2012," it said in a statement.

"But despite the frequency of such violence, the Pakistani government has a poor track record of bringing the perpetrators - and those who incite them - to justice."

In Pakistan's biggest city Karachi, more than 5,000 police are expected to patrol the streets during Muharram events over the next two days. Tens of thousands are expected to take part in processions in Islamabad.

Muharram marks the anniversary of the Battle of Karbala, where the grandson of the Prophet Mohammad and his family members were killed.

Western intelligence agencies have mostly focused on anti-American groups like al Qaeda and the Taliban in Pakistan, paying far less attention to sectarian hardliners who are becoming an increasing deadly and effective force.

Pakistani intelligence officials say extremist groups led by Lashkar-e-Jhangvi have intensified their bombings and shootings of Shi'ites in the hope of triggering conflict that would pave the way for a Sunni theocracy in U.S.-allied Pakistan.

The schism between Sunnis and Shi'ites developed after the Prophet Muhammad died in 632 when his followers could not agree on a successor.

Sunnis recognize the first four caliphs as his rightful successors. The Shi'ites believe the prophet named his son-in-law Ali. Emotions over the issue are highly potent in modern times, pushing some countries, including Iraq five years ago, to the brink of civil war. Pakistan is nowhere near that stage.

But officials worry that LeJ and other groups have succeeded in dramatically ratcheting up tensions and provoking revenge attacks in their bid to topple the U.S.-backed government, which faces a host of other challenges as well which fuel instability.

Pakistan's economy is weak, chronic power cuts cripple vital industries like textiles, and frustrations are growing over a lack of basic services and crumbling infrastructure.

Protests greet shoppers at Walmarts nationwide

PORTLAND, Ore. (AP) ? Wal-Mart workers and supporters marched in protest at a number of stores nationwide Thursday and Friday, blasting the wages, benefits and treatment of employees of the world's largest retailer.

The efforts seemed to do little to keep shoppers away though ? Wal-Mart Stores Inc. said it was its best Black Friday ever.

In Paramount, Calif., authorities arrested a small group of protesters Friday outside a Walmart. Elizabeth Brennan of Warehouse Workers United said nine people, including three employees, were arrested shortly after 12 noon for blocking the street outside the store in Paramount. At one point, however, more than 1,000 people blocked traffic outside the store, Sheriff's Capt. Mike Parker told KNBC-TV.

In Lakewood, Colo., shoppers hesitated as they passed dozens of protesters outside a Walmart but entered without incident. Some protesters held signs playing off of the retailing giant's corporate slogan, "Live better," accusing the company of corporate greed and underpaying its workers.

"This is the way you get a fair shake. You've got to fight for it. You've always had to," said protester Charlie May, of the Industrial Workers of the World labor organization.

A union-backed group called OUR Walmart has said that it is holding an estimated 1,000 protests in 46 states. The exact number is unclear. Wal-Mart has refuted that estimate, saying the figure is grossly exaggerated and that the protests involved few of its own employees.

A number of demonstrations and walk-outs occurred last week at stores but were scheduled to culminate on one of the year's busiest shopping days.

OUR Walmart, made up of current and former Wal-Mart employees, was formed in 2010 to press the company for better working conditions.

The retailer filed an unfair labor practice charge with the National Labor Relations Board last week against the United Food and Commercial Workers International Union. The company said that the demonstrations organized by OUR Walmart threatened to disrupt its business and intimidate customers and associates.

Wal-Mart said roughly 50 employees participated in the events Thursday and a "few dozen" employees Friday. Company spokesman Dan Fogleman said that the number of associates who missed their shifts during the two days of events is 60 percent lower than last year.

"It was proven last night ? and again today ? that the OUR Walmart group doesn't speak for the 1.3 million Walmart associates," the company said in a statement.

The union group estimated that "hundreds" of employees participated nationwide.

Victoria Martinez, 29, marched in front of the store in Paramount on Black Friday. The Walmart photo department employee worked her shift on Thanksgiving but skipped work on Friday to "speak out". She said the company shows a lack of respect for employees, noting that she faced retaliation by local managers after speaking out about problems during an open discussion sponsored by the head office.

"I believe that when I started at this company, it was great," said Martinez, who's worked for Wal-Mart for seven years. "They've taken away everything that is great."

Wal-Mart for many years has faced intense scrutiny over its wage and benefit policies and treatment of its workers. Fogleman says that the company provides some of the best jobs in the retail industry and that its wages and benefits typically meet or exceed those of competitors. The retailer maintains that it has many long-term employees and that its turnover rate is below the industry average.

The company, based in Bentonville, Ark., operates 10,400 stores in 27 countries.

>> reporter: former investment banker paul peters was sentenced to 13 and a half years in prison after breaking into the family's luxury home in 2011 . maddy was at home alone studying. dressed in a ski mask and armed with a black baseball bat which this surveillance tape shows him purchasing, peters linked a chain with a small black box around maddy 's neck. before fleeing peters left information with maddy saying the black box was full of explosives and leaving instructions on how to transfer money. it took ten terrifying hours to determine there were no explosives.
