Appeals court: Ark. can't stop desegregation funds (AP)

LITTLE ROCK, Ark. ? Arkansas cannot cut off millions of dollars in funding for desegregation programs in Little Rock-area school districts until the state asks a federal judge for permission to do so, an appeals court ruled Wednesday.

The 8th U.S. Circuit Court of Appeals decision comes after U.S. District Judge Brian Miller ordered an end to most of the payments, calling them counterproductive. He accused the districts of delaying desegregation to keep getting state money.

The appeals court ruled that Miller decided to end the payments without the state specifically asking him to do so. The court said the state must ask, in a separate court action, before a judge could make such a ruling.

A spokesman for Attorney General Dustin McDaniel said Wednesday that no decision has been made about whether the state would file such a request.

Arkansas is required by a 1989 settlement to fund magnet schools, transfers between districts and other programs to support desegregation and keep a racial balance in the North Little Rock, Pulaski County and Little Rock school districts. Those costs currently add up to about $38 million a year, according to the appeals court's ruling.

State lawmakers have long wanted to end the desegregation program funding, though the districts say they're still necessary.

Battles over school desegregation in Little Rock date back to 1957, when nine black teenagers needed the protection of federal troops to integrate Central High School. Little Rock sued the state and its two neighboring districts in 1982, and two years later a judge agreed that the districts hadn't done enough to help the city schools desegregate.

Miller issued his order to end the payments earlier this year, after hearings about whether two of the three school districts in question ? North Little Rock and Pulaski County ? should be declared unitary, or substantially desegregated.

"That came kind of out of the blue," Stephen Jones, the lead attorney for the North Little Rock district, said Wednesday about Miller's ruling.

Miller wrote that the payments should end in order to avoid "an absurd outcome in which the districts are rewarded with extra money from the state if they fail to comply with their desegregation plans and they face having their funds cut by the state if they act in good faith and comply."

But the appeals court said Miller did not make "specific findings of fact" to support his decision.

Miller, who referred to himself as "a middle aged black judge," instead wrote: "After reading the briefs, the transcripts from the various hearings, and the scores of exhibits filed herein, it is very easy to conclude that few if any of the participants in this case have any clue how to effectively educate underprivileged black children."

The appeals court also reversed Miller's decision to deny the North Little Rock district's request to be declared unitary. Miller had denied the request in part because he said the district offered only anecdotal examples of its efforts to recruit black teachers.

The 8th Circuit disagreed, noting that more than 16 percent of the district's educators are black, compared to 9 percent statewide.

Miller didn't return a phone message left at his chambers Wednesday. But he removed himself from the desegregation case earlier this year, saying he could no longer make unbiased decisions after the state took over his hometown's school district in eastern Arkansas.

Jones, the North Little Rock district's lawyer, said he was pleased with the appeals court's decision to deem the district unitary.

"In a sense, it's anticlimactic because I don't think it really changes how we're going to conduct our day-to-day business," he said.

Another federal judge had previously declared the Little Rock district unitary, but Miller refused to declare the Pulaski County district entirely unitary in his May order. The appeals court upheld that part of Miller's ruling, which found the Pulaski County School District lacking in nine areas in which it had to make changes to be considered desegregated.

Wednesday's opinion notes that Miller found the Pulaski County district "has given very little thought, and even less effort to complying with its desegregation plan. Complying with its plan obligations seems to have been an afterthought."

The appeals court "found no reason to disagree" with Miller's conclusion.

The Pulaski County Special School District's lead attorney, Sam Jones, declined to comment Wednesday.

The Little Rock district's lead lawyer, Chris Heller, praised the appeals court's ruling, adding that part of Miller's decision in May "concerned issues that had not been presented to the district court."

McDaniel said in a statement that Arkansas is moving toward ending the legal action surrounding the decades-old desegregation case and in turn, "taking the courts out of the classrooms" in the county.

Former New Mexico Governor to run for president as Libertarian

Former New Mexico Gov. Gary Johnson, a longshot candidate for the Republican presidential nomination, said Wednesday he is leaving the GOP in favor of running as a Libertarian.

Johnson told a news conference at the state Capitol that the decision was difficult, but that he was "deeply disappointed" by the treatment he received in the Republican nomination process.

"I had hoped to lay out a real libertarian message on all the issues in the Republican contest. The process was not fair and open," he said.

Johnson has been excluded from all but two GOP presidential debates. He also has barely registered in the polls.

The former two-term governor said that if he earns the Libertarian Party's presidential nomination, he will appear on the ballots in all 50 states and will not be "held hostage to a system rigged for the wealthiest and best-known candidates in a handful of states who happen to have early primaries."

Johnson is fiscally conservative but supports legalizing marijuana and abortion rights.

He laid out an agenda that also includes ending deficit spending and cutting federal spending by 43 percent. He called for ending gun control, ending expensive foreign wars, cutting over-regulation and legalizing gay marriage.

"I believe this election needs a true libertarian voice," he said. "While Ron Paul is a good man and a libertarian who I proudly endorsed for president in 2008, there is no guarantee that he will be the Republican nominee."

(AP) ? Northwestern coach Bill Carmody was in mid-thought when he suddenly said of Ohio State's William Buford, "I don't know if you'd call it his team but ... he's a senior, right?"

Told that Buford was, indeed, the second-ranked Buckeyes' only senior, Carmody muttered, "Thank God."

Buford had career-highs of 28 points and five 3-pointers as Ohio State showed off its perimeter shooting in an 87-54 victory over Northwestern on Wednesday night in the Big Ten opener for both teams.

"I was just shooting the ball," said Buford, who was 9 of 14 from the field including 5 of 7 on 3-pointers. "I was fortunate to knock them down because my teammates were setting great screens for me. They kept telling me to shoot."

Next-to-last in the conference in 3-pointers at 4.8 per game, the Buckeyes hit seven in the first half to build a big lead and finished 10 for 20 from long range.

"We were saving it," Ohio State coach Thad Matta cracked.

It wasn't just a bunch of guys firing up shots from a distance, either. Jared Sullinger added 17 points and 14 rebounds for the Buckeyes (13-1, 1-0), who dominated the boards 49-30.

Deshaun Thomas had 16 points for Ohio State, which broke the game open with a 13-0 first-half run fueled by 3-pointers. Jordan Sibert added 12 points, all on 3s.

"Thad said at the end when we shook hands, 'This was about as good as we can play,'" Carmody said, adding "And we had a lot to do with that."

The conference's top two scorers, John Shurna and Drew Crawford, had miserable games. They were held to 11 and 13 points, respectively, on a combined 9-for-30 shooting.

The loss was the 31st straight for the Wildcats (10-3) in Columbus, dating to 1977.

Even when Northwestern pared what was a 19-point lead down to 12 in the second half, the Buckeyes pulled away again and Buford led the way.

He hit four free throws in a 10-3 run ? all the points coming at the line ? to push the lead to 59-39 with 11:55 left. By then, a refreshed Sullinger and point guard Aaron Craft, who sat out for several minutes due to foul trouble, were back on the court and the game was well in hand for Ohio State.

With Shurna and Crawford struggling ? shadowed wherever they went, taking bad shots when they did get a chance ? the Buckeyes took a 41-26 halftime lead.

The pace favored the Wildcats in the early going. They pulled to a tie at 13 on Davide Curletti's 3 at the 12:16 mark.

But the Buckeyes suddenly found the range behind the arc and the game teetered in their favor.

Sibert, just 8 for 31 on 3-pointers coming in, hit 3 of 4, as did Buford. Sibert's 3 ignited a 13-0 rally as the Buckeyes held the Wildcats scoreless for 4:36.

Craft had smacked Sibert's shooting hand in practice recently. Sibert said he had torn ligaments in it, but Sullinger joked that it was just "a little bruise."

The injury certainly didn't seem to bother him.

His four 3s and 12 points were career-highs.

"I had kind of gotten complacent in the spring and summer shooting and I didn't work as hard as I felt I needed to," he said. So he shot 400 or 500 extra shots per night with managers chasing down rebounds.

Matta joked that Sibert's shooting is so much better with the injured hand that even if it required surgery, Sibert would have to play through the pain.

"We're not going to fix it," Matta said, laughing. "We're going to leave it be."

Thomas continued the spurt by hitting a short jumper before Buford nailed a 3 and then made the play of the game. Shurna muscled past the smaller Craft and broke free for a short jumper but Buford went high to block it.

That seemed to set the tone for the rest of the surge. Sibert hit another 3 and Buford followed with a perimeter jumper that was first signaled a 3 but then discounted to a two-point basket after a video review.

The lead never dropped below 11 points again as Ohio State won its 34th straight home game and stayed perfect at home against Northwestern since 1977.

Buford, who came in averaging 8 points and 4 rebounds in five previous games against Northwestern, had 13 points and 7 rebounds at halftime.

Sullinger said Buford has grown into being a leader after remaining quiet for much of his first couple of years on campus.

"Will's doing a great job," he said. "He's more vocal. He's taking on a lot more of the leadership on himself this year."

Sibert said that with an Ohio State team that only has one senior and one junior (backup post Evan Ravenel), Buford has had a profound effect on the younger players.

"We look to Will," he said. "He finds a way to make sure our team stays in rhythm."

Community rallies to help victims of Christmas fire

A Christmas Day fire has left an Edneyville family homeless and in need of help.

Gary Moore, his wife, Sabrina, and the couple's three children were not at home when the blaze broke out around 2:30 p.m. Sunday. The fire completely engulfed the singlewide mobile home on Skipper Lane off Pilot Mountain Road in Edneyville, said Edneyville Deputy Fire Chief Mark Reagan.

"The home is gone," he said Monday, adding that the fire's cause has not yet been determined. "It's still under investigation by the Henderson County Fire Marshal."

Offers of help were already coming into the Henderson County American Red Cross office Monday, said Executive Director Mike Williams.

A man called the office and said that he noticed smoke in the trailer park while he was there visiting relatives and went to offer assistance, Williams said.

"When he saw the smoke, he went to the trailer and got the back door open and hollered for people, but no one answered," Williams said. "But there was a little black dog there, so he got the dog out."

The dog ran off, but Williams said the man wanted the family to know that the dog was unharmed by the fire.

The agency put the family up at a local hotel temporarily until other housing arrangements could be made.

The Moores lost everything in the fire, including Christmas presents for the three children, ages, 5, 7 and 11, he said.

"We sent out our disaster response team to provide immediate assistance," Williams said, adding that most likely other local agencies, such as the Salvation Army, will be providing assistance in the days to come.

Offers of help were already coming in the day after the fire, said Reagan.

"Toys for Tots contacted us this morning and expressed interest in replacing the toys," he said. "There's a lot of positive coming out of this already."

The Edneyville Fire Department has set up a collection box where donations may be dropped off at any time, said Fire Chief Robert Griffin. The box is located in the foyer of the fire department at 1 Firehouse Drive (off U.S. 64) in Edneyville.

The fire department is collecting clothes, toys, food and household items for the family. Clothing sizes are 7-8 Misses and 8 1/2 shoe for one of the daughters; 14 girls and 7 1/2 shoe for another daughter; and a child's size 6 with a 13 size shoe for the son. Adult clothing sizes needed are men's pants size 32, shirts size large and shoes size 11 1/2 shoe; and women's pants size 20, shirts size 2XL and shoes size 10.

Firefighters from the Dana, Bat Cave. Gerton and Hendersonville fire departments responded to the fire, along with the Henderson County Rescue Squad, EMS and the Henderson County Sheriff's Office, Reagan said.

Sadrists call for new elections in Iraq

The political party loyal to radical Shiite cleric Muqtada al-Sadr called Monday for the dissolution of Iraq's parliament and new elections in another move that could escalate the country's growing sectarian crisis.

The anti-American Sadrist bloc is a partner in the Shiite-dominated government of Prime Minister Nouri al-Maliki. Bahaa al-Aaraji, the head of the Sadrists' bloc in parliament, said the elections are needed because of instability in the country and problems that threaten Iraq's sovereignty.

"The political partners cannot find solutions for the problems that threaten to divide Iraq," he said.

Iraq plunged into a new sectarian crisis last week, just days after the last American troops withdrew at the end of a nearly nine-year war.

The new political crisis has been accompanied by a new wave of attacks on the Iraqi capital by suspected Sunni insurgents linked to al-Qaida. A suicide bomber set off a car bomb Monday at a checkpoint leading to the Interior Ministry, killing seven people and injuring 32, officials said. Police and hospital officials said the bomber struck during morning rush hour, hitting one of many security barriers set up around the ministry's building.

Al-Maliki is in a political showdown with the country's top Sunni political figure, Vice President Tariq al-Hashemi, after the government issued an arrest warrant for al-Hashemi on allegations his bodyguards ran hit squads targeting government officials.

The prime minister threatened to form a government without al-Hashemi's Sunni-backed political party, Iraqiya, which is boycotting parliament and mulling whether to pull out of the ruling coalition.

Iraq was dominated by the minority Sunnis under Saddam Hussein until the U.S.-led war that began in 2003 ousted him. Majority Shiites have dominated the government ever since, though Americans pushed hard for the inclusion of Sunnis with a meaningful role in the current governing coalition.

Bitter sectarian rivalries played out in 2006-2007 in violence that took Iraq to the brink of civil war and the latest tensions have raised fears of a resurgence of Shiite-Sunni violence.

The political crisis taps into resentments that are still raw despite years of efforts to overcome them. The Sunnis fear the Shiite majority is squeezing them out of their already limited political role. Shiites suspect Sunnis of links to militants and of plotting to topple the Shiite leadership.

The Sadrists have played an important role in maintaining Shiite domination over government ? their support last year catapulted al-Maliki back to the prime minister's office for a second term.

For the proposal to dissolve parliament to gain traction, it would take the consent of at least 1/3 of parliament, the president and the prime minister or a simple majority of lawmakers. Al-Maliki, who only secured his position after nearly nine months of political wrangling after the last elections, would likely be loathe to go through the process again and risk an unfavorable outcome.

Al-Aaraji said the proposal first needs approval of the larger coalition between the Sadrists and al-Maliki's alliance, the two most powerful Shiite parties.

A Shiite lawmaker loyal to al-Maliki, Kamal al-Saiedi, said the proposal should be studied.

"Forming the current government was not an easy issue, therefore going back in the direction of new elections would be more difficult," he said.

A Sunni lawmaker with Iraqiya, the Sunni-backed bloc of the wanted vice president, said new elections would not bring security and stability. He pointed to the prolonged negotiations that were needed to agree on the government in place now, and said a new election would only bring the same people to office.

"We need to sit around the same negotiating table and that is the only path to salvation from this current crisis," said Kamil al-Dulaimi.

Also Monday, a roadside bomb hit a passing army patrol in the Abu Ghraib area west of Baghdad, killing two soldiers and injuring two, a police officer and a doctor said.

Al-Maliki's adviser for National Reconciliation Amer al-Khuzaie, said leaders of Asaib Ahl al-Haq, one of the top Shiite militant groups, had decided to lay down their weapons and join the political system.

Asaib Ahl al-Haq, or Band of the People of Righteousness, was a splinter group from the Mahdi Army, also headed by al-Sadr. They, along with the Mahdi Army, were two of three Shiite militant groups active in Iraq that were dedicated to fighting the U.S. military presence.

Al-Khuzaie said the group had signed an agreement in recent days renouncing violence. He said they would change their name and join the political process. He said he had been negotiating for months with the group, who said they would join the political process after the U.S. military left Iraq. All American troops departed on Dec. 18.

Officials from the group were not available to confirm the decision.

U.S. officials have warned that these Shiite militant groups could turn against the Iraqi government after the American military has gone. A key test to whether Asaib Ahl al-Haq, an Iranian-funded group, is committed to becoming a peaceful part of the political process is whether they actually turn in their weapons, especially the more powerful and sophisticated weapons they're believed to get from Iran.

One bylaw standard will cover anaerobic digestion on farms in the Agricultural Land Reserve (ALR) and the other will cover combined heat and power co-generation in greenhouses in the ALR. Both systems present farmers possibilities to improve operating efficiency.

Anaerobic digestion systems use a combination of manure and organic materials to produce renewable energy in the form of methane gas. This methane gas can be upgraded to natural-gas quality or converted to electricity. A discussion paper and survey propose:

  • Minimum farm size on using a system.
  • Restrictions on the materials and their origins that can be used in the system.
  • Planning, administrative and record-keeping requirements.
  • Criteria for anaerobic digestion activities that would not require local-government rezoning.

Greenhouse growers use natural gas-based combined heat and power co-generation systems to produce electricity, heat and carbon dioxide, which are used to fertilize greenhouse crops. A discussion paper and survey propose:

  • Requirements that cogeneration production be commensurate with the heat demand on the farm and/or total greenhouse size.
  • Minimum operating efficiency.
  • Sites and management that minimize noise impacts.
  • Criteria for cogeneration activities that would not require local-government rezoning.

Bylaw standards are not legally binding. Rather, they provide interested local governments with criteria on a topic, should they be interested in developing a bylaw. The call for public comments follows the distribution of the ministry?s discussion papers to local governments and stakeholders.

Respondents are advised to familiarise themselves with the respective discussion paper prior to participating in the survey.

The surveys will be open until March 15, 2012. All comments will be included in the ministry?s consideration in developing the bylaw standards.

Shell Oil Messes Off Two Coasts

The spill occurred while it was transferring oil from a floating oil platform to a tanker.

Satellite pictures captured by independent monitors Skytruth (more here) show a 356-square-mile (923-square-km) slick approaching the oil-battered coast of the Niger Delta. All production from the Bonga field?normally about 200,000 barrels (7.2 million gallons) a day?has been suspended in the wake of the spill.

The Guardian reports on skepticism of Shell's estimates, based on its poor record in the region:

[A] leading Nigerian human rights group said Shell's figures about the quantity of oil spilled or the clean-up could not be relied on. "Shell says 40,000 barrels were spilled and production was shut but we do not trust them because past incidents show that the company consistently under-reports the amounts and impacts of its carelessness," said Nnimmo Bassey, head of Environmental Rights Action, based in Lagos. The spill, one of the worst off the coast of Nigeria in 10 years, is particularly embarrassing for Shell, coming only four months after a major UN study said it could take Shell and other oil companies 30 years and $1bn to clean spills in Ogoniland, one small part of the oil-rich delta. The company also admitted responsibility in August for two major spills in the Bodo region of the delta that took place in 2008, but has yet to pay compensation.

Shell also admitted to a spill in the Gulf of Mexico Sunday of some 13,400 barrels of drilling mud mixed with synthetic oil from the Deepwater Nautilus?a sister rig to the Deepwater Horizon.

The spill occurred at the Appomattox discovery, just 26 miles southeast of last year's disastrous spill. Shell plans five new exploratory wells at Appomattox, hoping to recover more than 250 million barrels of oil... though the Houston Chronicle reports it could be weeks before the company can resume drilling in the hotly-disputed site:

The Appomattox project is at the heart of a high-stakes dispute between environmentalists and the federal government over offshore drilling... In separate cases that have since been consolidated, conservationists are arguing that the government acted prematurely in green-lighting the plan without first finishing an environmental study of the Gulf... The cases present a major test of the federal government's power to swiftly review and approve deep-water exploration?plans.

Mel Gibson, wife finalize divorce in Los Angeles (AP)

LOS ANGELES ? Mel Gibson's three-decade marriage is officially over.

A judge finalized the actor-director's divorce on Friday from his wife Robyn, who was married to Gibson during his acting heyday and his more recent public downfall.

The judgment entered by Superior Court Judge Mark Juhas keeps virtually all details of the pair's split confidential. Neither Gibson nor his ex-wife, whose name is being restored to Robyn Moore, attended Friday's proceedings.

It does not indicate an official date for the former couple's separation. Robyn Moore did not list a date in her April 2009 divorce filing, although Gibson indicated they had been living apart since 2006.

The former couple have seven children together, but only their 12-year-old son is a minor and subject to a custody agreement.

The Gibsons' divorce has been more dramatically more low-key than Gibson's custody battle with Russian musician Oksana Grigorieva, who the "Braveheart" star agreed in August to pay $750,000 to settle a bitter dispute and split custody of their young daughter.

Recordings that sounded distinctly like the Oscar winning director engaged in a racist and sexist tirade were leaked during the couple's dispute. Grigorieva accused Gibson of domestic violence and he pleaded no contest, although admitted no fault, to a misdemeanor battery count earlier in March.

Robyn Moore came to her estranged husband's defense, filing a brief declaration in the Grigorieva case stating that Gibson had never physically abused her or their children.

Attorneys handling the divorce have worked for months to reach a settlement in the case and records show Robyn Moore signed the final judgment last week. Gibson signed it Wednesday, records show.

Corrected: Zhang, Bale blossom together on "Flowers of War" (Reuters)

LOS ANGELES (Reuters) ? In 100 years of Chinese film, "The Flowers of War" is the first major title to feature a western movie star. It earned a Golden Globe nomination for best foreign language film, and is China's entry for Oscars.

Budgeted at $100 million, "Flowers of War" stars Oscar-winner Christian Bale as John Miller, an opportunist mortician on the run in 1937 as the Japanese are invading the province of Nanking, now known as Nanjing. The Japanese occupation led to the deaths of thousands of Chinese citizens and came to be known by some as the Rape of Nanking or the Nanjing Massacre.

In the film, which has a limited U.S. release this week before opening nationwide in 2012, Bale's character must save a group of schoolgirls from the clutches of the Japanese. At the same time, he falls in love with a Chinese courtesan.

Bale and Chinese director Zhang Yimou, who communicated through an interpreter while making the film, talked with Reuters about overcoming cultural barriers and revisiting an infamous episode of China's past. (The interview took place before Bale's recent run-in with Chinese officials.)

Q: This is your first time working with a western film star. Did the collaboration meet or defy your expectations?

Zhang: "First, I'm amazed at how low key and humble Christian is. The stereotype that Chinese have of Hollywood actors is they probably have an entourage and assistants. So that's definitely changed how I viewed Hollywood actors. And also Christian didn't want to stay in a five star hotel either. He lived right above me, lived with everybody else, with the crew members. And another thing is Christian gave up his weekends to work with us because we work seven days a week."

Bale: "But this seven-day week schedule became something I quite enjoyed cause I liked the momentum. Yimou is top dog in his profession, and he genuinely seemed to have a great deal of humor and laughter on the set. I didn't always know what the laughter was about but I would laugh with them. I hope they're not all laughing at me! I felt surrounded by good friends and even if I didn't understand nuances of what was being discussed, I got the essence in the presence of people."

Q: Do you find that your shared experience in filmmaking was enough to communicate despite the language barrier?

Bale: "There would be moments where Yimou would come to me and we would work it out between the two of us. And sometimes with a scene it's very small adjustments that were being asked for and I could understand from body language. And I always was convinced Yimou spoke a little bit of English, more than he ever let onto. So we'd experiment and see how it works out and sometimes it did and sometimes it didn't."

Q: How are Western actors different than Chinese?

Zhang: "Each line Christian offered three or four different ways, which is very unusual because Chinese actors normally cannot pull that off. Screening the film for a western audience I realized that the first one-third of the movie, audiences would laugh at Christian's lines. That actually surprised me because when I wrote the script in Chinese, I didn't think that was humorous, but clearly Christian added other layers to it."

Q: I understand Zhang asked you to stand before the cast and give them acting tips but it proved awkward.

Bale: "I always think it's bad to try to alter anybody else's experience. Apart from that, it's not my job. That's the director's job. And I love very much working with actors who either have no experience or very little experience. I like to try to avoid getting any technique into my acting because I feel like the more known an actor gets, you really have to be exceptional to maintain that feeling of freshness and vitality and enthusiasm instead of falling back on your usual tricks."

Q: Steven Spielberg recommended you for the part after working with you years ago on "Empire of the Sun" when you were a child. Did working with kids on this movie take you back?

Bale: "Some of the girls would say to me, 'I would never want to act ever again in my life, this is it.' And I would say to them, 'That's what I said. That's exactly what I said when I was your age.' The thing that I liked so much was the freshness that they brought in terms of this is something new but there's no consideration of this being anything that they would continue with."

Q: The movie is set around an atrocity by the Japanese that rivals in brutality what the Nazis did in Europe. Why do you think the world hasn't held the Japanese accountable?

Zhang: "Maybe the international community doesn't know much about Nanjing because China, at that time, was really far behind, and they didn't have enough voice or power to actually speak out for themselves. For me, rather than arouse sad feelings, the goal of the movie is to make people see the good side of humanity and bring peaceful feelings to an audience."

WASHINGTON (AP) ? House Republicans on Thursday caved to demands by President Barack Obama, congressional Democrats and fellow Republicans for a short-term renewal of payroll tax cuts for all workers. The breakthrough almost certainly spares workers an average $20 a week tax increase Jan. 1.

After days of wrangling that even Speaker John Boehner acknowledged "may not have been politically the smartest thing in the world," the Ohio Republican abruptly changed course and dropped demands for immediate holiday season talks with the Senate on a full-year measure that all sides said they want. Senate leaders had insisted on the two-month extension to buy time for talks next year.

The House and Senate plan to act on the two-month extension Friday.

House Republicans were under fire from their constituents and GOP establishment figures incensed that they would risk losing the tax cut issue to Democrats at the dawn of the 2012 presidential and congressional election year. House GOP arguments about the legislative process and the "uncertainty" a two-month extension would mean for business were unpersuasive.

"In the end House Republicans felt like they were reenacting the Alamo, with no reinforcements and our friends shooting at us," said Rep. Kevin Brady, R-Texas.

The compromise legislation would renew the tax break through Feb. 29, along with jobless benefits and a "fix" to prevent doctors from absorbing a big cut in Medicare payments. Its $33 billion cost would be covered by an increased fee on mortgages backed by Fannie Mae, and Freddie Mac.

The developments were a clear win for Obama. The payroll tax cut was the centerpiece of his three-month campaign-style drive for jobs legislation that seems to have contributed to an uptick in his poll numbers ? and taken a toll on those of congressional Republicans.

"Because of this agreement, every working American will keep his or her tax cut - about $1,000 for the average family," Obama said in a statement. "That's about $40 in every paycheck. And when Congress returns, I urge them to keep working to reach an agreement that will extend this tax cut and unemployment insurance for all of 2012 without drama or delay."

If the cuts had expired as scheduled, 160 million workers would have seen a 2 percentage point increase in their Social Security taxes. And up to 2 million people without jobs for six months would start losing unemployment benefits averaging $300 a week.

The GOP retreat ends a tense standoff in which Boehner's House Republicans came under great pressure to agree to the short-term extension passed by the Senate on Saturday. The speaker was initially open to the idea, but rank-and-file Republicans revolted, and the House instead insisted on immediate talks on the year-long measure passed by the House, which contains curbs to unemployment insurance and other ideas backed by conservatives ? as well as deeper spending cuts to pay for the full-year cost.

After Senate leaders tried but failed to match the House's goal for a full-year pact, the chamber on Saturday instead gave sweeping approval for the two-month extension of the payroll tax cut, jobless benefits and doctors' Medicare fees that otherwise would have been cut 27 percent. The House had just days before passed a full-year extension that included a series of conservative policy prescriptions unpalatable to Obama and congressional Democrats.

Obama, Republicans and congressional Democrats all said they preferred a one-year extension but the politics of achieving that eluded them. All pledged to start working on that in January.

"Has this place become so dysfunctional that even when we agree to things we can't do it?" Obama asked. "Enough is enough.".

The top Senate Republican, Mitch McConnell of Kentucky, was a driving force behind Thursday's agreement, imploring Boehner to accept the deal that McConnell and Senate Democratic Leader Harry Reid had struck last week and passed with overwhelming support in both parties.

"There remain important differences between the parties on how to implement these policies, and it is critical that we protect middle-class families from a tax increase while we work them out," Reid said after Boehner's announcement.

The breakthrough emerged as a firewall erected by tea party-backed House Republicans crumbled Thursday.

"I don't think that my constituents should have a tax increase because of Washington's dysfunction," said freshman Rep. Sean Duffy, R-Wis.

The Republican establishment, too, put new pressure on House Republicans to compromise.

The 2008 GOP presidential nominee, John McCain, former Bush administration confidant Karl Rove and The Wall Street Journal editorial page were among conservative voices urging House Republicans to retreat.

Just hours before he announced the breakthrough, Boehner had made the case for a year-long extension. But on a brief late afternoon conference call, he informed his colleagues it was time to yield.

"He said that as your leader, you've in effect asked me to make decisions easy and difficult and I'm making my decision right now," said Rep. Jack Kingston, R-Ga., paraphrasing Boehner's comments.

Kingston said the conference call lasted just minutes and Boehner did not give anyone time to respond.

There was still carping among tea party freshmen upset that GOP leaders had yielded.

"Even though there is plenty of evidence this is a bad deal for America ... the House has caved yet again to the president and Senate Democrats," said Rep. Tim Huelskamp, R-Kan. "We were sent here with a clear set of instructions from the American people to put an end to business as usual in Washington, yet here we are being asked to sign off on yet another gimmick."

Almost forgotten in the firestorm is that McConnell and Boehner had extracted a major victory last week, winning a provision that would require Obama to make a swift decision on whether to approve construction of the Keystone XL oil pipeline, which would bring Canadian oil to the U.S. and create thousands of construction jobs. To block the pipeline, Obama would have to declare that is not in the nation's interest.

Obama wanted to put the decision off until after the 2012 election.

House Republicans did win one concession in addition to a promise that Senate Democrats would name negotiators on the one-year House measure: a provision to ease concerns that the 60-day extension would be hard for payroll processing companies to implement.

Civil union couples spread throughout central Illinois

All but one county in the Springfield area has issued civil union licenses since the law creating civil unions in Illinois went into effect June 1.

The sole exception is Cass County west of Springfield.

More than 150 civil union licenses have been issued in the other counties, mostly to same-sex couples but with a smattering also issued to opposite-sex couples. Illinois law allows both same-sex and opposite-sex couples to enter civil unions.

They are among the more than 3,700 civil union licenses issued around the state in the opening months of the law.? The statewide numbers were compiled by Equality Illinois, a lesbian, gay, bisexual and transgender advocacy group.

?In the first six months of civil unions becoming available, thousands of couples rushed out and got their civil union licenses,? said Bernard Cherkasov, CEO of Equality Illinois.? ?It says just how urgent the need for these benefits protections has been.? Many of these couples have been together for many, many years and have been denied these benefits and protections.?

Not just Chicago

Equality Illinois contacted all 102 counties to determine how many civil union licenses had been issued through the end of November.? The organization found 3,729 civil union licenses had been issued.? Ninety counties reported issuing at least one.

?The fact that 90 counties already have civil union couples in them is significant,? Cherkasov said.? ?That means people who need civil unions, same-sex couples particularly, are in every part of the state.? They?re not just in Chicago.? They live in every city and town.?

Even those counties that didn?t report issuing any licenses might have civil union couples living in them, Cherkasov said.

?They may have gotten married in Iowa or Massachusetts or in Canada, and their marriage is already recognized in Illinois as a civil union,? he said.

Cass County Clerk Michael Kirchner could not be reached for additional comment.

In similarly small Menard County, though, three licenses have been issued.

?That?s probably in the ballpark where I figured it,? said County Clerk Gene Treseler.? ?We?re a small county, so we weren?t expecting too many.?

That?s also the number issued in much larger Macoupin County.? Ann Easton of the Macoupin County clerk?s office said one license was issued to a male couple, one to a female couple and one to a heterosexual couple.

106 in Sangamon

Among Springfield-area counties, Sangamon County has issued the largest number of civil union licenses by far.? County Clerk Joe Aiello said the county had issued 106 licenses as of last week.? By comparison, the office has issued 728 marriage licenses since June 1.

Aiello said the number of civil union licenses could pick up over the next few days.

?I could see some people wanting to have a ceremony New Year?s Eve or New Year?s Day,? he said.? ?I wouldn?t be surprised if we see a little increase over the next week.?

Of the 106 civil union licenses issued so far by his office, Aiello said, 34 were issued to male couples and 68 to female couples.? The other four were issued to heterosexual couples.

?It was rather busy at first, that first day, first week,? Aiello said.? ?It?s kind of tapered off.? It?s been rather steady since then.?

Morgan County Clerk Jill Waggener said her office has issued 16 civil union licenses.? Two that she knows of went to heterosexual couples.

?Why they didn?t want a marriage license, I don?t know,? she said.

Like other county clerks, Waggener said there have been no problems administering the new law.

?It?s a normal everyday routine, just like issuing marriage licenses,? she said.

?Our entire system and procedures and software that pertains to marriage licenses easily transferred to civil unions,? said Montgomery County Clerk Sandy Leitheiser.? Montgomery County has issued eight licenses.

Christian County Clerk Linda Curtin said seven civil union licenses have been issued so far.

?We had a few at the beginning, and then we get one every once in a while,? Curtin said.? ?It?s been slow compared to some counties.?

Logan County has issued nine civil union licenses, said County Clerk Sally Litterly.

?I?m not surprised, because I really didn?t know what to anticipate,? she said.

Rep. Greg Harris, D-Chicago, an openly gay member of the General Assembly, said many Illinois couples might have gone to other states that legalized gay marriage or civil unions before Illinois.

?I would guess that there are thousands of people who didn?t go through the paperwork here who are also now legally recognized,? he said.

For a while, he said, there was a ?spate? of instances where civil union couples reported cases of people not complying with the law. Mostly, he said, it was a case of people simply being unfamiliar with the requirements.

?They?re trying to figure out to whom the law applies and how they need to apply it,? Harris said.? ?Most people have figured it out and adjusted their policies and moved on.?

Cherkasov said Equality Illinois has launched a civil union tracker to help couples ensure they are being treated fairly under the law. Information about the civil union law and the protections it provides are available on the organization?s website, equi.org.

No push this year for gay marriage

Harris said he?s pleased with the results of the law.

?I just could not be happier,? he said.? ?I?m getting emails from folks all around the state thanking us for getting this done.?

Harris said his ultimate goal remains legalization of gay marriage, but that might have to wait.

?The whole legislature is up for election this time. Everyone has a new district,? Harris said.? ?The state?s in financial turmoil.? I?m not sure that, for a variety of reasons, there are a lot of issues that you would probably not want to call for a vote right now.?

Instead, Harris said, he will be vigilant against efforts to weaken the law.

The Illinois Family Institute wants to see lawmakers adopt at least one change ? legislation that would essentially put organizations like Catholic Charities back in the foster care/adoption business.? The state refused to renew contracts with Catholic Charities because it would not place children in homes of unmarried couples, including those in civil unions.

?We?re backing legislation to try to address the unmitigated disaster that has befallen the religious adoption agencies and foster care agencies in the state of Illinois,? said David Smith, executive director of the institute.

Joint tax returns required

Couples in civil unions must file joint tax returns with the state Department of Revenue, a reversal of an earlier position taken by the department.

The department initially said couples in civil unions had to file individually because federal law does not allow them file as married couples.? After looking at the way New York handled filings by couples in same-sex marriages, the Illinois department revised its procedures.

Revenue spokeswoman Sue Hofer said the change won?t provide a financial benefit to civil union couples because of Illinois? flat rate system.

?What could impact your tax bill are credits you get in Illinois -- for instance your property tax credit, your education credit if you send your kids to school,? Hofer said.? ?Those, it?s easier if you combine them into one return.?

The downside for civil union couples is they have to file additional paperwork and they have to do it manually. Couples must complete a federal return as if they were married, including all federal schedules that apply to that status and submit it along with the state tax return.?

Civil union couples can file either married-filing-jointly or married-filing-separately state returns, according to the department web site.

?We?re providing civil union couples as best we can the same rights and responsibilities of married couples,? Hofer said.

BBC Sports Personality of Year: Mark Cavendish left 'speechless' after win

Mark Cavendish was last night named BBC Sports Personality of the Year.

The cyclist won the Road Race World Championship in Copenhagen in September, the first British champion since Tom Simpson in 1965. He also won five stages of the 2011 Tour de France, taking his total to 20, and this year's green jersey. Open golf champion Darren Clarke finished second with 5,000m world champion Mo Farah in third.

"I'm absolutely speechless really," he said on receiving the prize. "And I think a few of the guys, my team-mates here, will say that's a rare thing. But without those guys this wouldn't be close to possible. I had a group of guys in Copenhagen who rode incredibly, to bring the rainbow jersey back to Britain."

Cavendish was delighted to see the recognition for his sport. "For me it's a landmark in cycling, I think I take this on behalf of cycling," he said. "For cycling to be recognised in a non-Olympic year, a few years ago it would be unheard of. It's incredible to see it."

Five-time Olympic gold medal winner Steve Redgrave, meanwhile, won the Lifetime Achievement Award. He was praised by the Princess Royal for his contribution to British sport, and hopes that it will continue. "It really is a lifetime of achievement," she said.

"Frankly we wouldn't have done as well in our Olympic bid if it wasn't for Sir Steve. His fundraising activities have continued, not only with his own foundation but charities up and down the country. I hope this is a lifetime achievement award ? so far!"

The England cricket team were named team of the year, after a remarkable 2011 in which they became the No1 Test team in the world. The year started with England completing a 3-1 Ashes victory in Australia, their first win in an away Ashes series for 24 years. They rose to first place in the summer, after beating India 4-0 at home.

Captain Andrew Strauss was unsurprisingly delighted with the award. "This is a very special award for us to win," he said. "There are so many great teams who have won this in the past. The team is more important than the individual and we've all bought into that. Thanks to [team director] Andy Flower and the coaching staff, they have pushed us when we didn't want to be pushed."

As a reward for the same achievements, team director Flower won coach of the year. Flower has been in charge since early 2009, and has overseen the radical transformation in England's fortunes which culminated in the successes of 2011.

"This is a very proud moment for me to stand here, I moved from Zimbabwe a few years ago and England has been very good to me and my family," Flower said. "I'm very proud to be part of the England cricket team. They have done some wonderful things over the last couple of years. I think everyone in this room realises it's the players that make the hard decisions, play under pressure and have to deliver. It's great to have a good bunch of players and a good bunch of people to work with."

Teenage golfer Lauren Taylor was named Young Sports Personality of the Year. The 17-year-old won the Ladies' British Open Amateur Championship and Royal Portrush in June, becoming the tournament's youngest winner in its 112-year history. She also competed in the British Open at Carnoustie.

Rajoy sworn in as Spanish prime minister (AP)

MADRID ? Conservative Mariano Rajoy was sworn in as Spain's new prime minister Wednesday and prepared to announce the names of the Cabinet ministers he hopes will help him lift Spain out of its severe economic crisis.

Rajoy took the oath on the bible before King Juan Carlos and Queen Sofia in the Zarzuela Palace on Madrid's outskirts. He then went to the Moncloa palace government headquarters to complete the transfer of power to the new government.

He replaces Socialist party leader Jose Luis Rodriguez Zapatero, who had been in office since 2004.

Rajoy was to return to the royal palace Wednesday evening to inform the monarch of his choice of ministers before making them public.

Rajoy's Popular Party won a landslide victory in Nov. 20 elections on promises to lift Spain out of economic turmoil.

Spain has a eurozone-high unemployment rate of 21.5 percent, a swollen deficit and a stalled economy after a near two-year recession triggered by the collapse of a real estate bubble in 2009.

Rajoy has given no clues as to who he will name to the key portfolio of economy, although Popular Party economy spokesman Cristobal Montoro has been heavily tipped for the post.

Spain has already made sharp cuts to its national spending and introduced several reforms under Zapatero but the measures have so far failed to boost the economy to any great extent.

The country's borrowing costs spiraled amid fears it might need a bailout like Greece, Ireland and Portugal but in recent weeks they have begun to slip back.

Rajoy, however, on Monday pledged more austerity cuts totaling euro16.5 billion ($21.6 billion).

The conservative leader promised reforms to encourage companies to hire and tax breaks for small and medium-sized firms that make up the bulk of the economy. He also intends trimming government personnel with a hiring freeze for most civil servant groups.

He is expected to announce further measures Friday after his first weekly Cabinet meeting.

A property registrar by training, Rajoy held four ministerial portfolios in the governments of Jose Maria Aznar between 1996 and 2004.

He was the party's candidate twice before being elected in November.

Game Informer is back to its teasing ways. Last month, the magazine?s staffers somewhat hyped up last month?s issue by saying the January cover ?may be the most surprising of the year?. This turned out to be South Park: The Game.

This time around the folks over at Game Informer believe that the developer behind their upcoming reveal will be shocking. When asked if fans could potentially guess the mystery game, editor-in-chief Andy McNamara said on Twitter:

?I think you could (though it?s not announced), but doubtful you would get the real nuts which is the developer.?

He added, ?I can pretty much promise not many will see this one coming?.

We?re quite a ways away from the announcement.?McNamara confirmed that they?ll be showing Game Informer?s next cover on January 5.

Shooting reported at Calif. electric utility

Updated at 6:05 p.m. ET:?Baldwin Park police Capt. Michael Taylor said at a press briefing that there are no confirmed deaths at the?Southern California Edison office in Irwindale.

There are "under six victims, and none of the wounds are life-threatening," Baldwin said.

The gunman was shot, but it isn't yet known whether his wound was self-inflicted, Baldwin said. It was not immediately clear whether the gunman was included among those with "non-life-threatening injuries."


Updated at 5:59 p.m. ET: Authorities now say only one person, the gunman, has been killed at the Southern California Edison office in Irwindale. Two other people are reported to have been injured.

Updated at 5:57 p.m. ET: Southern California Edison says it will hold a news conference shortly.

Updated at 5:48 p.m. ET: KTLA-TV quotes police as saying the gunman shot a man and a woman, killing one of them, before killing himself. Fire officials confirm that one person is being treated for injuries.

Original post: IRWINDALE, Calif. ? A building housing offices of Southern California Edison was evacuated Friday as police searched for possible victims of a gunman who shot and killed himself and a second person, local reports said.

SoCal Edison officials confirmed that there was a shooting at their office building in Irwindale, northeast of Los Angeles,?but were unable to provide further details.?

KTLA-TV of Los Angeles reported that the gunman and one other person were dead. Two schools near the building were locked down, but authorities said they did not believe there was a second gunman.
